Lease transfer: Owner cannot demand tenant pay debt prior to the actual transfer

In a decision made last fall, the Régie du logement accepted a tenant’s request to cancel her lease. The owner was asking her to reimburse the amount due and the credit-check fees before transferring the lease. According to the Régie, this request does not comply with the Civil Code of Quebec on lease transfers.
