In a decision handed down this winter, the Small Claims division of the Court of Québec declined jurisdiction, declaring the Régie du logement the only relevant authority to judge the owner’s request for damages. The Court rejected her argument designating the lease as a vacation lease, finding instead that it was in fact a residential lease.
