The Régie du Logement recently recognized the claim of a landlord’s insurer against a tenant whose air conditioner’s water-leakage caused damages.

The tenant’s air conditioner had been inadequately installed. The floor of their apartment and the ceiling of the tenant situated below were also damaged. The property owner received compensation of $5,540 by his insurer. Afterwards, the insurer exercised his right of subrogation by suing the offending tenants. 

However, the court only granted half of the amount, which comes to $2,770, in addition to the $78 court costs, since it appears that only one tenant had received the request and the lease did not project their joint responsibility.
