A repeat illegal subletting offender gets his lease terminated

In a ruling handed down in December 2016, Administrative Judge Marc Lavigne of the Régie du logement terminated the lease of a tenant who failed to obtain the landlord’s authorization to sublet his apartment. This is the latest ruling in the case opposing the parties. The housing board has confirmed what it has asserted in other rulings: in subletting their unit, a tenant may have changed the destination (use) of the dwelling in violation of Quebec’s Civil Code.
