Can a landlord charge for excess electricity consumption?

According to a recent TAL decision, no. A landlord must ensure that he or she complies with the terms of sections 1903, 1904 and 1906, which state that the price of rent must be clearly determined and not subject to change from month to month. A landlord who pays for electricity in a dwelling should therefore not include a clause in the lease stating that the additional cost, beyond an agreed upon monthly consumption limit, would be borne by the tenant.
